Barranca Verde Terms of Use

1. About these Terms

Barranca Verde (the "Service") is an irrigation-monitoring product operated by Totavi, LLC ("Totavi," "we," "us," "our"). Use of the Service is governed by:

1. Totavi's general Terms of Use ("Master Terms"), which cover the broader Totavi relationship, including limitation of liability, arbitration, dispute resolution, and choice of law; and
2. These Service-Specific Terms (the "Service Terms"), which add provisions particular to the Barranca Verde product.

The Master Terms are incorporated by reference. If there is a conflict between the Master Terms and these Service Terms regarding a matter specific to Barranca Verde (for example, subscription billing or third-party device integration), these Service Terms control. For all other matters, the Master Terms control.

2. Acceptance and eligibility

By creating a Barranca Verde account or using the Service, you confirm that you have read and agree to both the Master Terms and these Service Terms. You must be at least 18 years old and reside in the United States. If you do not agree, please do not use the Service.

3. What the Service does

Barranca Verde connects your Rachio irrigation controller and Flume water monitor to track per-zone water usage and estimated cost. The Service requires valid, active accounts with both Rachio and Flume and depends on their APIs to function.

4. Your account

• You must provide accurate information when signing up.
• You are responsible for keeping your password secure and for all activity under your account.
• Notify us promptly at hello@barrancaverde.com if you suspect unauthorized access.

5. Subscription and billing

• A free plan is available with limited features (30 days of usage history). A paid plan unlocks full history and additional charts.
• Paid plans are $5.00/month or $50.00/year, billed in advance. The annual plan saves $10 versus paying monthly.
• Paid subscriptions auto-renew until cancelled. You can cancel at any time from Settings → Billing in the app; your paid access continues until the end of the current billing period.
• Prices may change with 30 days' advance notice. Changes will not affect the current prepaid period.
• Payments are processed by Stripe. We do not store your payment card details.
• Refunds are not issued for partial billing periods, but we will consider requests for billing errors. Email hello@barrancaverde.com.

6. Acceptable use

In addition to the conduct rules in the Master Terms, you agree not to:

• Attempt to circumvent subscription limits or security controls.
• Reverse-engineer, scrape, or resell the Service.
• Use the Service in a way that disrupts its operation for other users or that imposes excessive load on the underlying Rachio or Flume APIs.
• Provide third-party credentials you are not authorized to use.

7. Third-party services

The Service integrates with third-party hardware and APIs, including Rachio and Flume. Your use of those services is governed by their respective terms and privacy policies. We are not affiliated with Rachio or Flume and are not responsible for changes to their APIs, pricing, or service availability that may affect Barranca Verde.

8. Accuracy of data

Water-usage data and cost estimates shown in the Service are provided for informational purposes only. Flume's API typically has a 3 to 6 hour lag, so usage figures are not real-time. Cost estimates are derived from the billing rate schedule you configure and may not exactly match your utility bill. Do not rely on this data for official reporting, regulatory compliance, or leak detection.

9. No warranty

The Service is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the Service will be uninterrupted or error-free, that data will sync without delay, or that the Service will operate correctly during Rachio or Flume outages. The disclaimers and limitations of liability in the Master Terms apply to the Service in full.

10. Termination

You may delete your Barranca Verde account at any time. We may suspend or terminate accounts that violate the Master Terms or these Service Terms. Upon termination, your data will be deleted in accordance with our Privacy Notice. Provisions of the Master Terms that are intended to survive termination (including limitation of liability, indemnification, arbitration, and choice of law) will continue to apply.

11. Changes to these Service Terms

We may update these Service Terms from time to time. We will notify account holders by email before material changes take effect. Continuing to use the Service after the effective date of an update constitutes acceptance of the updated Service Terms.
